Terms of Service

These terms govern your use of Bugmole ("Bugmole"), provided by The AI, Inc. ("we", "us"). Bugmole includes this website, the Bugmole dashboard and registry, and the Bugmole CLI and project worker. By creating an account, installing the CLI, or otherwise using Bugmole, you agree to these terms. If you use Bugmole for an organization, you agree on its behalf and confirm you are authorized to do so.

1. The service

Bugmole explores your application, plans and generates tests, runs them across browsers and devices, and helps you investigate failures. Some parts run on our infrastructure; others run on machines you control. Features may change as we improve the product, and some may be labelled preview or beta, which means they may be incomplete or change without notice.

2. Your account

You are responsible for your account, for keeping your sign-in and API keys confidential, and for everything done with them. Tell us promptly at info@theaiinc.com if you believe your account or a key has been compromised, and revoke the key from the dashboard.

3. Acceptable use

You may only point Bugmole at applications, environments, and accounts you own or are authorized to test. You agree not to:

• test, scan, or load third-party systems without permission;
• use Bugmole to disrupt, overload, or gain unauthorized access to any system, including ours;
• run destructive actions against production systems or real customer data;
• use Bugmole to create or send spam, or misuse the temporary inboxes it provides;
• attempt to bypass usage limits, access controls, or security measures;
• reverse engineer the service except where the law allows it despite this restriction;
• use Bugmole in violation of any law or anyone's rights.

We may suspend access that we reasonably believe violates these rules or puts Bugmole or others at risk.

4. Your content

"Your content" means the projects, configuration, test plans, flows, tasks, and evidence you create or that Bugmole produces for you. You keep all rights to it. You give us permission to host, process, and display your content only as needed to provide and support Bugmole for you. You are responsible for your content and for having the rights to use any data your tests handle; please use test accounts and test data.

5. AI features

Bugmole uses AI models to plan tests, write code, and analyze failures. AI output can be wrong or incomplete. Review generated tests, suggested fixes, and code changes before you rely on them or merge them. Where you configure your own AI provider, your use of that provider is also governed by its terms.

6. Third-party services

Bugmole works with services you choose to connect, such as GitHub, cloud storage providers, CI systems, and AI providers. Your use of those services is governed by their terms, and we are not responsible for them. Disconnecting an integration stops Bugmole's access going forward.

7. The Bugmole software

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Bugmole CLI and project worker to use the service during your subscription or trial. The software is proprietary to The AI, Inc.; you may not sell, sublicense, or redistribute it, except for open-source components, which remain under their own licenses.

8. Plans and fees

Plans, their allowances, and prices are listed on our pricing page. Enterprise terms are agreed separately.

• Free plan. Each person may own one Free workspace. Cloud minutes and AI credits on Free stop when the month's allowance is used up, and cloud minutes require a confirmed email address.
• Subscriptions. Paid plans are billed in advance through PayPal each month or year and renew until cancelled.
• Additional usage. Usage beyond a plan's allowance is billed after each monthly period, at the rates shown on the pricing page, through an invoice sent by PayPal and due within 15 days. You can set a monthly spending limit; once it is reached, cloud runs and AI work pause until the next period or until you raise it.
• Changing plans. Upgrades take effect immediately, and we refund the unused part of the plan being replaced. Downgrades take effect at the end of the current period.
• Cancelling. Your plan remains active until the end of the paid period and is not refunded, except as required by law.
• After a paid plan ends. Content is not deleted, but projects beyond the Free plan's limit become read-only until you upgrade.
• Failed payments. If a payment fails or an invoice is more than 7 days overdue, cloud usage continues for 7 days and then pauses until the payment is made. Runs on your own machines are not affected. If a failed renewal isn't paid within a further 14 days, the workspace moves to the Free plan.
• Taxes. Prices exclude taxes. You are responsible for any sales, use, or value-added taxes that apply to your purchase.
• Price changes. We may change prices. We will tell you before a change applies to your subscription, and it takes effect from your next renewal.

9. Feedback

If you send us ideas or suggestions, we may use them without obligation to you.

10. Availability and changes

We work to keep Bugmole available and reliable, but we do not promise uninterrupted service. We may modify or discontinue features. If we discontinue Bugmole entirely, we will give you reasonable notice so you can retrieve your content.

11. Disclaimers

Bugmole helps you find problems; it does not guarantee that your software is free of defects, secure, or fit for any purpose. To the fullest extent permitted by law, Bugmole is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of liability

To the fullest extent permitted by law, neither we nor our suppliers will be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of Bugmole. Our total liability for any claim relating to Bugmole is limited to the greater of the amount you paid us for Bugmole in the twelve months before the claim or one hundred US dollars. Some jurisdictions do not allow these limitations, so they may not fully apply to you.

13. Indemnity

You will defend and indemnify us against claims arising from your content, your use of Bugmole against systems you were not authorized to test, or your breach of these terms.

14. Termination

You may stop using Bugmole at any time and ask us to delete your account. We may suspend or end your access if you breach these terms or if required by law. Sections 4, 9, and 11 through 16 survive termination.

15. Changes to these terms

We may update these terms. We will post the new version here and update the date above, and for material changes we will notify you before they take effect. Continuing to use Bugmole after that means you accept the updated terms.

16. General

These terms are the entire agreement between you and us about Bugmole unless you have signed a separate agreement with us, which then controls. If a provision is found unenforceable, the rest remains in effect. Failing to enforce a provision is not a waiver. You may not assign these terms without our consent. These terms are governed by the laws of the jurisdiction in which The AI, Inc. is organized, without regard to its conflict-of-laws rules.
